In the name of God Amen, this ninth day of April in the year of Our Lord 1788. I John Durham of Little Creek Hundred and County of Kent in the Delaware State Yeoman being very sick and weak in Body but of perfect Mind and Memory thanks be given to Almighty God therefore and Calling to Mind the Mortality of my body and knowing that its is appointed for all men once to die do make and ordain this my last will and Testament, that is to say, principally and first of all I give my Soul into the Hands of God that gave it, and for my body, I recommend it to the Earth to be buried in a Christian Like and decent manner at the discretion of (unclear) my executors herein after named nothing doubting But at the General Resurrection I shall receive the same again by the mighty power of God and as touching such worldly Estate as it hath pleased God to bless me with in this life I give devise and dispose of the same in the following manner and form.

Imprimis it is my will and I do ordain that in the first place all my Just Debts and funeral charges be paid and satisfied.

ITEM I give devise and bequeath unto my three beloved sons William Durham, Isaih Durham and Whitenton Durham all my estate both real and personal Lying and being in Little Creek Hundred and County aforesaid after my Just Debts and funeral Expences be paid and discharged & all legacies herein after mentioned be likewise paid and discharged, to be equally divided between my said three sons William, Isaih, Whittington Durham, to them and their heirs and assigns forever.

ITEM I give and bequeath unto my four beloved daughters that is to say Sarah Sisco, Letitia Lacount, Elizabeth Concilar and Hanah Concilor the just full sum of five pounds in gold and silver to be paid to each daughter separately, to be paid in one year after my decease which said five pounds (unclear) to each daughter, I give to them and their use forever.

ITEM I do will and bequeath unto Rebecca Durham the sum of five pounds yearly and every year for the space of four years for use of help in Raising my son John Durhams children. And in the case of her death I do ordain that whoever hath the care of said children, they shall be paid the sum of five pounds a year until the said term of four expires.

I give and devise unto Clayton Durham the just and full sum of Ten pounds in (unclear) when he shall arrive to age.

Lastly I constitute make and ordain my dearly beloved friend Robert Holiday of Duck Creek Hundred merchant my only and sole Executor of this my Last Will and Testament all and singular the Lands Gifts and legacies as aforesaid and I do hereby utterly disallow revoke and disannul all and any other former testaments Wills Legacies and Executors by me in any wise before this time named willed and bequeathed, Ratifying and confirming this and no other to be my last will and testament. In witness I have hereunto set my hand and Seal the day and year as first above written.

Est. fr. I understand that John Durham is deceased & left me his Ex. to undertake this business don't suit me, this is at liberty to grant administration to such person or persons as they may think best. With Respect thy friend Rob. Holiday.

Personally appeared before me Thomas Rodney Esq. Register for the probate of wills and granting Letters of Administration in and for the County of Kent and state aforesaid Thomas Keith and Mary Consilar two of the subscribers & witnesses to the within and foregoing instrument of writing and being solemnly sworn on the Holy Evangelists of Almighty God deposeth and saith that they were present on the ninth day of April Anno Domini 1788 and saw John Durham sign and seal and heard him publish pronounce and declare this same as and for his last will and testament, that at the time of his so doing he was to the best of their belief of sound disposing Mind and Memory, that they at his instance and request and in his presence and in the presence of each other signed and saw each other sign their names as witnesses and at the same time at the like instance and request and in his and in their presence they saw Eleanor Puckim sign her name as one other witness to the same. In Testimony whereof I have here unto set my hand this 14th day of May 1788.

Be it remembered that on the fourteenth day of May Anno Domini Seventeen Hundred and eighty eight, the last will and testament of John Durham, deceased, was proved and approved in due form and Letters of Administration at the same time granted to Francis Denny who being sworn gave bond in the sum of One thousand pounds with Silas Snow for the faithfull performance there of agreable to Law
