In the name of God Amen , the fourth day of December in the year of our Lord 1779. I Daniel Durham of Little Creek Hundred and County of Kent of the Delaware State Yeoman being very sick and weak in body but of perfect mind and memory thanks be to God therefore and Calling to mind the Mortality of my body and knowing that it is appointed for all men once to die do make and ordain this my last will and Testament that is to say principally and first of all I give my Soul into the Hands of God that gave it and for my body I recommend it to the earth to be buried in a Christian like and decent manner at the discretion of my Excr. hereafter named nothing doubting but at the general Resurrection I shall receive the same again by the mighty power of God and as touching such worldly estate wherewith it hath pleased God to bless me with in this life I give demise and dispose in the following manner and form.

Imprimis it is my will and I do ordain that in the first place all my Just debts and funeral charges be paid and satisfied. ITEM I give demise and bequeath unto Elennor my beloved wife all my lands during her Natural life or widowhood. ITEM I likewise give to my said wife all my personal Estate during her widowhood after the legacies herein after named are discharged. ITEM I give demise and bequeath to my son Benjamin after the decease of his mother or her Entermarrying again all my lands to him his heirs and assigns forever he paying Yearly and every year after he shall be possessed of the same to my son Daniel the sum of ten Bushels of Wheat and two Bushels of Corn. ITEM I give to my said son Benjamin one bay colt one cow and one bed and furniture to him and his use forever. ITEM I do likewise give to my said son Benjamin one Boy Named George till he arrives to the age of twenty years. ITEM I do give to my son Daniel all my wearing apparel. I do ordain that my son Benjamin pay to my son Thomas the full sum of fifty pounds when he shall arrive to age. ITEM I do order and my will is that after the decease of my wife or Entermarrying again all my personal Estate that shall be found shall be equally Divided between my six daughters Joanah, Hester, Rachel, Mary, Ellenor and Sarah to them and their use forever. Lastly I Constitute make and ordain my dearly beloved Wife Ellenor Durham (and Benjamin Durham) my only and sole Executors of this my last will and Testament all and singulars the Lands Gifts legacies aforesaid & I do hereby utterly disallow revoke and Disannul all and every other former Testaments Wills Legacies and Executors by me in any way before this time named Wills and Bequeathes Satisfying and Confirming this and no other to be my last will and Testament In witness whereof I have hereunto set my hand and Seal the day and year first above written; Signed Sealed Published pronounced and declared by the said Daniel Durham as his last will and Testament in the presence of us the Subscribers.

Personally appeared before me Thomas Rodney Esq. Register for the Probate of Wills and Granting Letters of Administration in and for the County of Kent Thomas Keith & James Smith two of the Subscribing witnesses to the within Instrument of Writing and being Sworn upon the Holy Evangelists of Almighty God so say that they saw Daniel Durham by way of making his mark, Sign Seal and heard him Publish pronounce and Declare the same as and for his last Will and testament and at the time of his so soing and Saying he was to the best of their belief of Sound and disposing mind and memory that they at his Instance and request and in his presence did with James Wells Sign their names as witnesses to the same In Testimony whereof I have hereunto set my hand at Dover this 17th day of August Anno Domini 1786.

I Eleanor Durham Widow of Daniel Durham late of Kent County in the State of Delaware Farmer deceased and one of the Executors in the Testament and last will of said Daniel Durham named finding my self very infirm and by no means able to Transact any part of the business do hereby renounce all my right & Title to the Executorship of the said will witness my hand & Seal this 17th Day of August 1786
