In the name of God Amen. I Daniel Durham of the County of Kent in Delaware State being weak in body but of sound mind and memory and considering that is is appointed for all men once to die, I do hereby make ordain and declare this to be my last will and testament in manner and form following and first I commit my soul into the hands of Almighty God my creator and my body I recommend to the earth to be buried at the discretion of my Executor hereafter named nothing Doubting but at the General Resurrection I shall receive the same by the almighty power. I give devise and bequeath unto the person following all my lawful debts being paid. I give to my wife Nicey Durham half of my personal estate and after her decease to be equally divided between my two youngest heirs of my body. I give to my son Hugh Durham my young rone main colt. I give all the rest of my personal estate to be equally divided between Parker, Hugh, Joseph and Sarah Durham and the one not born and I do hereby constitute and appoint my Loving wife Nicey Durham executor and my friend Elijah Conceler Executors of this my last will and testament and I do hereby revoke all former wills by me made and only to be my Last Will and Testament. In writing whereof I the said testator Danl. Durham do hereby set my Hand and Seal. I publish and declare this only to be my last will and testament this first day of October in the year of our Lord One thousand seven hundred and ninety five.

Personally appeared before me Isaac Davis register for the probate of wills and granting of Letters of Administration for the County aforesaid. Lewis Gano Sen. and Benjamin Durham the subscribing witnesses to the within will, who being sworn on the holy Evangelists of Almighty God do say they saw and heard Daniel Durham the testator sign, seal, publish and declare the same as his last will and testament, that at the time of his doing and saying, he was, to the best of their knowledge of sound disposing mind, memory and understanding and also that they signed their names as witnesses thereto. In testimony whereof I have hereunto set my hand on the twenty eighth day of April 1801.

Be it remembered that on the twenty eighth day of April Anno Dom one thousand eight hundred and one, the last will and testament of Daniel Durham dec'd was in due form of Law proved by the oaths of Lewis Gano Senior and Benjamin Durham, witnesses to the same before one Isaac Davis register for the probate of wills and granting Letters of Administration for the county of Kent in the state of Delaware and the same being by me approved, Letters of Testamentry at the same time were granted unto Unicy Bass late Unicy Durham executrix therein named and Griffin Bass who being sworn gave bond with Peter Stout their surity in the sum of six hundred pounds lawful money of the said State, as by Bond filed with the will may more fully and at large appear.
